Redevelopment is meant to upgrade your living standards, but without legal vigilance, residents risk losing significant usable space. Developers routinely leverage technical jargon, varying area definitions, and misleading loading calculations to shrink actual flat sizes while promising bigger numbers on paper. Understanding measurement definitions and your statutory rights is your strongest defense against area dilution.

Decoding the Area Terminology
To protect your rights, you must understand what these four terms actually mean:
RERA Carpet Area: Under the Real Estate (Regulation and Development) Act, 2016, this is the net usable floor area inside your flat, including internal walls. It strictly excludes external boundary walls, balconies, and terraces. Under MahaRERA, this is the only legal basis for agreements.

MOFA Carpet Area: Defined under the older Maharashtra Ownership Flats Act, 1963, this measured net usable floor space excluding all walls and balconies. A MOFA carpet figure is roughly 3% to 5% smaller than RERA carpet for the exact same physical flat.

Built-up Area: This includes RERA carpet area plus external boundary walls and attached private balconies or flower beds. It is typically 10% to 15% larger than RERA carpet.

Super Built-up Area: A non-statutory term that adds a proportionate share of common areas (lobbies, staircases, lifts) using artificial “loading factors” (30%–50%). It inflates flat sizes on paper without providing actual living space.

Essential Safeguards for Societies
• Insist on RERA-to-RERA Comparison: Demand that the Development Agreement (DA) defines both existing and proposed flat sizes strictly in RERA Carpet Area.
• Separate Balcony Line Items: Ensure carpet area and exclusive balconies are listed as distinct, separate schedules in agreements.
• Appoint an Independent Architect: Hire a society-appointed architect to independently survey all existing flats before signing the DA.
• Insert Deficit Compensation Clauses: Include a strict penalty clause mandating cash compensation at market rates if final constructed flats fall short of agreed RERA carpet areas.
