The Indian legal system provides strong constitutional and statutory protections designed to uphold the safety, dignity, financial independence, and equal status of women. Understanding these fundamental legal provisions is essential for resisting injustice, whether in the domestic sphere, at the workplace, or within the criminal justice system.

  1. Protection Against Domestic Abuse & Right to Residence
    Under the Protection of Women from Domestic Violence Act, 2005 (PWDVA), women are protected from physical, emotional, verbal, sexual, and economic abuse within a shared household:
    • Right to Reside: A woman possesses an absolute right to reside in the shared household, irrespective of whether she holds legal title or ownership.
    • Statutory Reliefs: Judicial Magistrates can grant immediate Protection Orders, Monetary Relief (maintenance/medical expenses), Child Custody, and Residence Orders preventing dispossessory actions by family members.
    • Accessible Redressal: Aggrieved women can access designated Protection Officers in every district to file applications without mandatory court fees.
  2. Workplace Safeguards: The POSH Act, 2013
    Under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013:
    • Internal Committee (IC): Every establishment employing 10 or more people must maintain an Internal Committee headed by a senior woman employee to redress complaints.
    • Local Committee (LC): For establishments with fewer than 10 workers or the unorganized sector, district-level Local Committees handle grievances.
    • Time-Bound Redressal: Inquiries must be completed within 90 days, ensuring strict confidentiality and protection against retaliation.
  3. Procedural & Police Protections
    Under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS):
    • Arrest Safeguards (Section 43(5)): No woman can be arrested after sunset and before sunrise, except in extraordinary circumstances where a woman police officer obtains prior written permission from a Judicial Magistrate. Male officers are strictly prohibited from touching a woman during arrest.
    • Zero FIR: A woman can register an FIR at any police station across India, regardless of jurisdiction, whenever a cognizable offense is committed against her.
    • Identity Protection: The identity and records of sexual offense survivors cannot be disclosed under any circumstances.
  4. Equal Succession & Property Rights
    Under the Hindu Succession (Amendment) Act, 2005, daughters possess equal coparcenary rights by birth in ancestral property on par with sons. Furthermore, a woman holds absolute, unassailable ownership over her Streedhan (all gifts, jewellery, and assets received before, during, or after marriage).
